Hongkong, 16th January, 1902.

Sir,

I have the honour to inform you that in connexion with the recent increases of salaries to subordinates, approved in your telegrams of the 26th November and 10th December last, a question has arisen as to whether an Officer having resigned the Government Service since the first of January, 1901, is entitled to receive arrears of salary.

This question was referred by Sir Henry Blake to the Acting Colonial Treasurer and the Attorney General, whose replies were in the affirmative.

In view of the opinions of these two Officers, the question was also raised as to whether the case of Mr. D. Gibbs was not also deserving of reconsideration. I attach herewith copies of minutes by the Director of Public Works and the Attorney General on the subject, and request that I may be furnished with the necessary instructions on the point raised.

Mr. Gibbs' case was dealt with in Sir Henry Blake's Despatch No. 408 of 8th September, 1900, and Your Despatch No. 340 of 24th October, 1900.
